Land registry procedure

Postby convoy2 » Sat Dec 30, 2017 2:08 pm

A creditor gained a Bankruptcy Notice entered as a pending action and a restriction on a title I own, after a claim for monies.
The debt was re paid, this was 7 years ago but now I have looked it is still there, what is the procedure to remove this?

The Creditor would not assist in any way in this process.

Thanks

The Land Registry has a pretty good help line, try them.

I think you will need to apply to amend the register. You will need evidence that the debt has been discharged. If there was a bankruptcy petition, can you provide an order dismissing it.

Presumably you were not made bankrupt. If not, were the proceedings withdrawn or dismissed?

Be clear as to teh exact nature of the entry on the title.

If it is a restriction, then (from memory) you are unable to remve it yourself - the person enering it must do so. However, I suspet tere is also a proper costs threat if it is not removed when propery required.
As has been said, there is much n HMLR website to assist.

Happy new year
The order states, "It is ordered that the petitioner has leave to withdraw this petition with the debtor agreeing to pay to the creditor the sum of X within a period of twelve months" (which we did)
