Hypothetical question.





If the register for 2 adjoining properties says the dividing walls or fences are party walls or fences . Does the right to erect a party wall astride the boundary last forever.

I am not sure that such a right begins. A party wall is one shared in ownership by the two owners. It is erected by agreement.

A right exists to erect a fence within the boundary.

There is a right to maintain a shared fence or wall, so why not rebuild if a previous fence or wall was removed but not replaced.

If erected by a developer of two adjoining houses, on sale of those houses does not a right under s62 covey such a right.
