Penalty for lying on a witness statement?

Postby TenaciousB » Mon Mar 19, 2018 2:12 pm

According to the CPS perjury is when someone gives false information orally in court.

What is the comeback if someone has given false information on a witness statement?

Perverting the course of justice and wasting police time.

Prison is possible: ask Jeffrey Archer.

It all depends on the scale and seriousness of the offence.

In case it makes any difference, this is for a criminal, not civil, matter.

Would it not depend on whether the lie was provable and whether or not you believed it was true when the statement was wrote.
It's ok your children are safe, they're locked away behind barbed wire gates. If you don't comply sir they'll send you another fine sir.

For example. The witness stated that they had won a previous court case. The judgment from that court case stated that they had lost. This is only one of the elements in the witness statement. The lie is provable. No reasonable person could believe that they had won when there is a judgment to the contrary.

I believe, but cannot quote a source (although I think I read it on here somewhere) that to prosecute for perjury it has to be shown that the lie could have altered the outcome of the trial. Perhaps the same line might be taken with a lie on a written statement?

No, the CPS have confirmed that perjury is only for oral statements.
