Avoiding VAT?

Hello, I recently consulted a solicitor. At the end of the consultation the solicitor suggested I pay him in cash and did not ask for an invoice. By doing that I would not be charged VAT. I took up his offer as it reduced my cost. I know avoiding tax is unethical but were we both breaking the law or only one party?

The real offence is committed when and if he submits a false VAT return.

There was something brought in about this, but I doo not know that an offence as such was created.

We've had a thread on this: potentially both commit an offence.

Is there any possibility that this solicitor's turnover is so low that he does not have to register for VAT?
