I couldn't pretend to provide a definitive explanation of the 'legalese' but this offence was at one time a bread and butter offence commonly dealt with by police officers, particularly in their probationary period. I must have issued hundreds of penalty notices for this offence.

I suspect your main problem may be whether or not this law has not been superseded or dispensed with. The police now do not deal with many of these 'trivial' offences, but that doesn't mean that they have ceased to exist. If it's still current then you can run a private prosecution. A quick check finds the offence has been 'decriminalised' so the police don't do it. The local authority can deal, as much as they deal with anything.

The issue is its legitimately attached to a vehicle on a lit street
