To revise a Budget post-CMO, prepare a Supplementary Budget

If a Costs Management Order has been made but a revision is required, my preference is (with the prior consent of the opponent) to:
leave the approved or agreed Costs Budget form Precedent H as it is;
disregard costs actually incurred since the CMO was made; and
prepare a Supplementary Budget containing only the additional costs that are necessitated by the change in circumstances.

If another revision is required, then a Second Supplementary Budget can be prepared.

Where parties have agreed to this approach, courts have endorsed it.

Draft consent order for Supplementary Budgets post-CMO

Here is the term of an order that provides for supplementary costs budgets and has been endorsed by the County Court. (This is part of a consent order that grants the parties permission to rely on written evidence from experts in another discipline.)
The parties to file and serve further supplementary cost budgets limited to the additional costs of and caused by this application by 4pm on 28 April 2017 and to notify the Court whether the budgets have been agreed by 2 June 2017. In the event the supplementary cost budgets cannot be agreed the matter shall at the parties request be listed for a further costs case management hearing on a separate date.

Thank you Tim. That makes sense where the court has made a procedural order that expands the scope of work, so that a supplementary budget needs to be prepared to cover the additional work, disbursements etc.
