Magistrates CPS cost of £!200

Magistrates CPS cost of £!200

Postby veritas2409 » Sat Apr 09, 2016 8:47 am

Have you ever heard of such amount being given for 1.5 day hearing in a magistrate court ? Is there any way of getting this varied without doing a full appeal to the crown court?

Do you mean £1,200, or "£200!"?

Sadly, these questions are often also about how difficult you make it for them. If you raise issues which prove, after their investigation, to have little effect, then they will have done rather more, and the costs will similarly be greater.

At the same time, 1200 for a day and a half is not at all a large sum. It may be a considerable pain in the rear for you, but it sounds (I may easily be wrong) as if some fair part of that was successfully arguing a point which was never going to have any weight.

This page:

http://www.cps.gov.uk/legal/a_to_c/cost ... s_of_cost/

gives the CPS advice on costs.

For a summary trial the range is based on complexity and is (per day)
Lower - £620
Average - £775
Higher - £930

It looks as if yours was considered averagely complex!

All financial penalties ought to take means into account and you will have filled in a means enquiry form.

I don't think those rates are per day. Nothing to indicate that. The CPS tried to exact revenge as sought a JR of the decision to prosecute for a book , however as the punishment was a £4 comp order I don't think they should get a penny for that

The simple thing is that the order was made. You were given chance to object.
I doubt that you should, but you can play double or quits by appealing.

What you have said so far does not demonstrate an understanding of the way the system works such as to suggest you should rely on your own views.

Get a proper advice from someone who knows the full story.

I was stating facts , it isn't day rates and for amounts <£5 no costs should be awarded , smarta** which of these facts do you disagree with

You may find somewhere else a forum which will happily go along with your opinion that you are right.

Did you mean to put in 3 asterisks, and not 2?
