Legal Aid Assessment

Legal Aid Assessment

Postby Sadoldman » Tue Apr 21, 2015 10:21 am

Can a request for assessment of legal aid costs by the court still be made pursuant to the revocation or discharge of a legal aid certificate?

Was looking at CPR PD 47 (sad I know) and under the current version under 13.3 'The document giving the right to detailed assessment' means such one or more of the following documents as are appropriate to the detailed assessment proceedings, this no longer contains the provision "a notice of revocation or discharge under Regulation 82 of the Civil Legal Aid (General) Regulations 1989".

If you can still seek assessment pursuant to the revocation or discharge, what is this now done pursuant to?

(I know the LAA will assess pursuant to this discharge)

Any thoughts?

Welcome to the board.

We have very few specialists in costs stuff here, so you may have to wait a while for a useful answer.

The headings in the model forms of bill of costs at Precedents C and D say
in accordance with Regulation 107A of the Civil Legal Aid (General) Regulations 1989

I cannot recall any problems with courts in this regard.
