Surrendering the premises via parol

If a tenant agreed into surrendering the keys to a premises via parol (on the telephone, with evidence of the transcript), then surely that counts as a contract which the tenant is bound by.

Word is the bond.

And therefore the landlord can act upon this.

Scots law warning - i know it no - this is EW

Contracts concerning land generally have to be in writing.
