Statute case law and practice in Northern Ireland

Leading Cases:
    Maye, Re (Northern Ireland); HL 6-Feb-2008 - The defendant had admitted charges of obtaining property by deception. A confiscation hearing concluded that he had benefitted to a much greater extent than could be recoverd. Before then however both his parents had died, and he stood to inherit further sums, though grants had not been taken out. The DPP applied to vary the confiscation order to allow for the anticipated increase in his funds. He had also since settled an action against the police in which he was awarded £2,500 for false imprisonment.
    Regina -v- Secretary of State ex parte Toner and Walsh; NIQB 1997 - The claimants sought damages saying that the respondent had infringed their human rights in removing their right to vote in an election whilst serving prison sentences.

      An Act to enable common investment funds to be established for the investment of moneys in certain courts in England, Wales and Northern Ireland and certain other moneys; to make fresh provision for dealing with funds in the Senior Courts in England and to amend the law concerning dealing with funds in county courts in England and Wales or in the Mayor’s and City of London Court; to amend the law concerning giving security by way of making a deposit with the Accountant General of the Senior Courts in England; to make miscellaneous amendments of the law relating to that court and to inferior courts in England and Wales; to amend section 8 of the Prosecution of Offences Act 1879; to enable benefits under section 10 of the Courts of Justice Concentration (Site) Act 1865 to be commuted into capital sums; to amend the War Pensions (Administrative Provisions) Act 1919; to enlarge the legislative power of the Parliament of Northern Ireland and amend the Criminal Appeal (Northern Ireland) Act 1930; to repeal certain obsolete, spent, unnecessary or superseded enactments; and for purposes connected with the matters aforesaid.

      An Act to make new provision for enabling the High Court, the Court of Session and the High Court of Justice in Northern Ireland to assist in obtaining evidence required for the purposes of proceedings in other jurisdictions; to extend the powers of those courts to issue process effective throughout the United Kingdom for securing the attendance of witnesses; and for purposes connected with those matters.

      An Act to make provision for a register of tobacco retailers; to make provision for dealing with the persistent commission of tobacco offences; to amend the Health and Personal Social Services (Northern Ireland) Order 1978; to confer additional powers of enforcement in relation to offences under that Order and the Children and Young Persons (Protection from Tobacco) (Northern Ireland) Order 1991; and for connected purposes.

      An Act to make provision about donations, loans and related transactions for political purposes in connection with Northern Ireland; to amend the Northern Ireland Assembly Disqualification Act 1975 and the Northern Ireland Act 1998; to make provision about the registration of electors and the administration of elections in Northern Ireland; and to make miscellaneous amendments in the law relating to Northern Ireland.
