In order to succeed in a negligence claim you will need to prove:

a) that the defendant owed you a duty of care. The nature and extent of the duty will need to be proved.

b) that the defendant breached that duty of care.

c) that the breach of duty caused loss or damage.

d) the loss or damage.

Fail to prove any of those and you lose your case.
