Dinna fash - but Atti is correct. Scots law is often similar to E&W, but is unpredictably different. It is what keeps Scots lawyers in their Ferraris.

Split the difference and assume £550. You can accept the offer and be sure of £315. If you sue you may not get more than that, so is it worth risking £100 to get £235?

I considered this, difficult one as I rejected there offer. I let anger get in the way because of the venue's "attitude" and wanted to pursue for as much as possible and the fact the jacket value had risen.

Your last post is good. One advaantage of having a lawyer is that a cool head isavailable to look at teh botto line without becoming caught up in the emotional burdens suffered by a party.

I agree it is important not to get too worked up. This type of problem needs to be assessed as if it were a business decision. Just as a good businessman knows when it is time to write off bad debts, so he knows when it is time to settle a claim and move on.
