Just to add. The manufacturers are required by the EU to submit their cars for testing and are required to publish those results when they advertise the cars for sale. Given the legal requirements to do so can the manufacturers be responsible if those figures do not reflect the reality? The manufacturer of the vehicle would have to publish the figures regardless of whether they believed them to be credible. Surely any claim would only arise from the manufacturer breaching the rules of the testing rather the publishing the resulting figures.
