Wills and minors

Wills and minors

Postby Albert » Sat Jun 17, 2017 12:38 pm

Scenario: Husband dies leaving estate to child (a minor who by court order is in full-time care of social services). Wife has been given right to live in house. There is only one executor who is being guided by widow. Executor is liquidating the assets of the estate.

Question: Who is responsible for looking after the interests of the minor?

The executor would appear to be trustee for the minor.

The executor should _not_ be acting alone as a trustee
