Limiting Exposure in a Claim

Limiting Exposure in a Claim

Postby donarebun » Wed Feb 14, 2018 5:59 pm

Hi Everyone,

I'm looking for a particular case law.

I believe it is in Road Traffic law (not sure)

Basically, Party A took Party B to the Small Claims Court for a little amount

(Party A were entitled to more but were trying to limit their exposure)

However, Party B felt Party A should have asked for a bigger amount

The Judge agreed with Party A and said that each Party should be entitled to pursue the Claim they wish to pursue.

If anyone knows this particular case law or something similar, it would be greatly appreciated

Thanks

Can I suggest that you have a look around Gordon Exall's "Civil Litigation Brief" blog.
