Hello to everyone reading this. I hope there is someone here that can give some advice on this matter. It is concerning my sister and her partner. They have been cohabiting now for almost three years they are 50/50 in the house and have some debt together (exact amount i'm unsure of). Their relationship is toxic due to both of them being emotionally childish. She is an alcoholic and he is a narcissist! She has been on the end of some nasty mental abuse and he feels that the alcaholism has contributed exclusively to the break up of the relationship. I have just got of the phone to her and she tells me that he said he has got a solicitor and he is going to take all the money that is in the house when they sell it because she is an acoholic. Now I don't know the law but surely no solicitor will take this complaint and make a case for complete aquisition of the property or money. She has two small children also.

The sale proceeds, after payment of mortgage, should be distributed in accordance with the agreed ownership of the property. That is what a court will order.

Oh! Haha... I googled Stack v Dowden and and looked at the wikipedia entry.
